The Government of Saskatchewan has officially launched a constitutional reference case in the Saskatchewan court of appeal to challenge the federal governments carbon tax, saying its unconstitutional to force it on provinces.

A move that NDP opposition leader Ryan Meili says will be pointless, and potentially costly.

Premier Scott Moe says that the province should receive federal funding to reduce emissions, despite saying no to the tax.

The federal plan sets a starting price at $10 per tonne of carbon dioxide emissions this year, escalating to $50 per tonne in 2022. The money collected by the tax would go back to the province.

Saskatchewan could lose $62 million dollars from the Low Carbon Economy Fund by not signing the framework.

Last Fall, Manitoba asked for legal advice as to whether they could win a court challenge against the tax. After receiving the opinion however, they decided to sign the federal framework.
